These Terms of Service ("Terms") govern your use of The Moab Guide website and services (the "Service") operated by The Moab Guide ("we", "us", or "our"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

1. Use of the Service

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Share or distribute protected trail locations or archaeological site information publicly without authorization
  • Exploit, harm, or attempt to exploit or harm others, including damaging sensitive archaeological or natural sites
  • Transmit spam, advertising, or promotional material without our prior written consent
  • Impersonate The Moab Guide, our staff, another user, or any other person or entity
  • Attempt to gain unauthorized access to protected content or user accounts
  • Use automated systems (bots, scrapers) to access the Service without permission

2. User Accounts

When you create an account with us, you are responsible for:

  • Maintaining the security of your account and password
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account

We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion, especially if we believe there is a violation of these Terms or risk to sensitive sites.

3. Protected Content and Archaeological Sites

Certain trail locations, archaeological sites, and other sensitive information on our Service are protected and require an account to access. By accessing this protected content, you agree to:

  • Respect Archaeological Sites: Do not disturb, remove, or damage any artifacts, petroglyphs, or archaeological features
  • Leave No Trace: Follow Leave No Trace principles and pack out all trash
  • Keep Locations Confidential: Do not share GPS coordinates or specific directions to protected sites on social media or public forums
  • Respect Closures: Obey all trail closures and land management regulations
  • Travel Responsibly: Stay on designated trails to prevent erosion and habitat damage

Violation of these guidelines may result in immediate account termination and could be reported to land management agencies.

4. Intellectual Property

The Service and its original content (trail descriptions, photos, maps, and text), features, and functionality are and will remain the exclusive property of The Moab Guide and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works of any content from the Service without our express written permission.

5. User-Generated Content

If you submit reviews, photos, or other content to our Service, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content. You represent that you own or have the necessary rights to submit such content.

Our Service may contain links to restaurants, lodgings, tour operators, and other third-party businesses. We are not responsible for:

  • The content, accuracy, or availability of third-party websites
  • The quality of services provided by listed businesses
  • Transactions between you and third-party businesses

Listings and links do not constitute endorsements. Always research businesses before booking or purchasing services.

7. Disclaimer of Warranties and Outdoor Activities

IMPORTANT: Outdoor activities including hiking, mountain biking, and rock climbing involve inherent risks. The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.

We make no warranties regarding:

  • The accuracy of trail conditions, difficulty ratings, or distance information
  • Weather conditions or trail accessibility
  • Your safety while participating in outdoor activities
  • The condition or availability of facilities, roads, or trails

You assume all risks associated with outdoor activities. Always check current conditions with land management agencies, carry appropriate safety equipment, tell someone your plans, and turn back if conditions are unsafe.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, The Moab Guide, its directors, employees, partners, and affiliates shall not be liable for:

  • Any injuries, accidents, or death resulting from outdoor activities
  • Lost or stolen property during your travels
  • Damages from using (or inability to use) the Service
  • Inaccurate or outdated information on the Service
  • Issues with third-party businesses, services, or bookings

Your use of the Service and participation in outdoor activities is entirely at your own risk.

9. Indemnification

You agree to indemnify and hold harmless The Moab Guide from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another person or entity
  • Damage to archaeological or natural sites

10. Changes to These Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice before new terms take effect. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
